EU Data Act – priorities for trilogues

Last year the European Commission released the Data Act proposal, a legislation meant to ensure fairness in the digital environment, stimulate a competitive data market, open opportunities for data-driven innovation and make data more accessible. Co-legislators are now holding informal interinstitutional negotiations to reach a first reading agreement on the proposal.

At this stage, policymakers should focus on achieving clarity in the new rules and address the outstanding concerns and ambiguity raised by industry stakeholders across all sectors. The American Chamber of Commerce to the EU (AmCham EU) would like to highlight certain concerns and recommendations in the field of cloud switching and interoperability, data sharing, international safeguards and transfers and retroactive applicability.

AmCham EU's consultation response in relation to the Consumer Agenda 2025-2030 calls on the Commission to streamline and harmonise consumer rules, accelerate digital product information, and provide clear EU-level guidance. Stronger action is also needed to protect consumers from counterfeit and unsafe goods while ensuring rules remain fair, future-proof and innovation-friendly.
